A CAIRNS businessman and author who is on the board of two charities has failed to beat a public nuisance charge after representing himself in court.
Shane Craig Cuthbert, 30, pleaded not guilty to one count of public nuisance in the Cairns Magistrates Court on Tuesday.
Giving evidence to the court, Senior Sergeant James Coates said he was on foot patrol with another officer in Abbott Street in the Cairns CBD at 9pm on February 27 when his attention was drawn to a group of people as a result of yelling and profanities.

Sgt Coates said he saw a man on the roadway who he later came to know as Shane Cuthbert, stop a motor vehicle and walk around to the passenger side of the vehicle, before stopping another three vehicles as he moved toward where he was standing on the median strip.
Sgt Coates asked Shane Cuthbert why he was stopping traffic, to which he responded, “I was just crossing the road”, the court heard.
Shane Cuthbert’s companions arrived on the median strip and there was a commotion.
In the course of the interaction, Sgt Coates said Shane Cuthbert grabbed at his chest near his bodyworn camera.

He then asked Shane Cuthbert to move to the side of the roadway, at which he said: “I am walking away” and he proceeded across the roadway.
Sgt Coates said he followed Shane Cuthbert, at which point Shane Cuthbert swung out his arm and lashed out at him.
Fearing he was about to be assaulted, he restrained and arrested Shane Cuthbert, Sgt Coates told the court.
Sgt Coates’ evidence was supported by footage from his bodyworn camera (see below).
Shane Cuthbert put forward an alternate case, explaining that he and his friends had finished dinner and were trying to find the Uber cars they had ordered.
He told the court that he was compliant with police directions and did not strike out at Sgt Coates but was rather trying to wave to his friends.
Magistrate Joe Pinder found Shane Cuthbert’s behaviour was “clearly” disorderly and that the charge was proved beyond reasonable doubt.
Discussing sentencing, Shane Cuthbert requested a conviction not be recorded as he was due to complete law school at the end of the semester and would be applying to the Supreme Court to practice as a lawyer.
Mr Pinder pointed to Cuthbert’s “substantial” criminal history, “the most recent entry of which is now, a round of drinks under two years ago where you were sentenced to a period of imprisonment”, and “a litany of (convictions) within 10 years”.
“Sir, the issue about your history and whether or not you get admitted is not going to swing too much on this,” Mr Pinder said.
Shane Cuthbert told the court he was self-employed and ran and operated a number of businesses, and was on the board of two charitable organisations, and performed a lot of community service.
He also said he had published 22 books internationally with proceeds donated to different organisations around the world.
Mr Pinder sentenced Shane Cuthbert to 50 hours unpaid community service and recorded a conviction.
